New Jersey has among the most active single-use packaging legislation in the region, and compliance is a real and present concern for food service operators.
New Jersey Statewide Plastic Bag and Polystyrene Ban (Effective 2022): New Jersey’s law bans single-use plastic carryout bags and polystyrene foam food service products at stores and food service businesses. It also bans single-use paper carryout bags at grocery stores 2,500 square feet or larger. This is one of the strongest statewide packaging laws in the country.
New Jersey "Skip the Stuff" Law: As of 2026, New Jersey's Skip the Stuff regulations require food service businesses to provide single-use items — including utensils, napkins, straws, and condiment packets — only upon customer request, not automatically included with every order. This applies to dine-in, takeout, and delivery. Violations can result in fines.
